U.S. Senate Majority Leader Mitch McConnell (R-KY) on Thursday lambasted House Speaker Nancy Pelosi (D-CA), often described as fearless and even never-daunted, as ā€œtoo afraidā€ to send the articles of impeachment to the Senate that were approved mostly along party lines with three Democrats defecting.

On the Senate floor Thursday, McConnell accused Pelosi of suggesting ā€œthat House Democrats may be too afraid … to even transmit their shoddy work product to the Senate.ā€

Referring to the development as ā€œcomical,ā€ McConnell said Democrats who stressed the urgency of the process now seem ā€œcontent to sit on their hands.ā€

McConnell, one of the top Republican leaders who has been holding the party together against the impeachment-fueled onslaught against Trump and his allies, taunted Pelosi’s threat to withhold the articles of impeachment until the GOP agrees to a fair impeachment trial.

ā€œThis particular House of Representatives has let its partisan rage at this particular president create a toxic new precedent that will echo well into the future,ā€ McConnell said from the Senate floor Thursday.

ā€œLooks like the prosecutors are getting cold feet,ā€ McConnell mused in remarks on the Senate floor after the House voted to impeach Trump along party lines.

Three Democrats defected, voting against at least one of the articles, while the Republicans remained together in their opposition.

House Democrats impeached Trump on abuse of power and obstruction of Congress. Trump joined the impeached president’s club as its third member.

Historically, the House sends the articles of impeachment approved in the House to the upper chamber — the Senate – for a trial.

Pelosi, however, appears to be doing what she knows best, playing legislative games. She has threatened that the Democrats would only send over the impeachment articles until she gets what she wants — the promise of a ā€œfairā€ Senate process.

ā€œWe’ll make a decision… as we go along,ā€ Pelosi told reporters Wednesday, adding that ā€œwe’ll see what the process will be on the Senate side,ā€ Fox News reports.

ā€œWe have acted,ā€ Pelosi continued, repeatedly refusing to commit to sending the articles of impeachment to the Senate. ā€œNow, they’ll understand what their responsibilities are, and we’ll see what that is.ā€

Many Republicans have balked at Pelosi’s request because they believe Democrats denied them a fair trial while Pelosi sat by and watched the show.

McConnell’s speech on the Senate floor came after House Democrats voted to impeach Trump for abuse of power and obstruction of Congress on Wednesday night.

On Thursday, Senate majority leader McConnell deemed the House impeachment vote — which passed without the support of a single Republican — as ā€œthe most rushed, least thorough, and most unfair impeachment inquiry in modern history.ā€

Impeaching Trump became an obsession for many Democrats soon after he took office.

Speaker Pelosi has vowed not to send the articles of impeachment against President Trump to the Republican-controlled Senate until they agree to make the Senate trial fair. House Republicans repeatedly made similar requests, but the Democrat majority ignored them.

So now, Democrats are complaining that Republicans are denying them the legislative commodities that just a few weeks ago they gleefully refused GOP lawmakers.

Pelosi’s threat not to release the articles of impeachment until she gets what she wants is a surprise move that plunges Congress’s timeline of Trump’s trial in the Senate into even more uncertainty.

Wells Fargo & Co. found that employees in its wholesale unit added information to internal customer records without the clients’ knowledge, according to a person briefed on the matter.

The bank discovered the improper activity and reported it to the Office of the Comptroller of the Currency, said the person, who asked not to be identified because the matter hadn’t been publicly disclosed. The employees altered the documents in 2017 and earlier this year as they sought to satisfy regulatory demands related to anti-money-laundering controls, according to the Wall Street Journal, which reported the issue earlier Thursday.

Wells Fargo has struggled to move past a wave of scandals, which led to a Federal Reserve ban on increasing assets until the lender fixes missteps. The bank’s first-quarter results were marred by a charge of $800 million tied to a settlement with U.S. regulators. Earlier this month, the bank rolled out a new marketing campaign built around its efforts to regain customers’ trust.

Bryan Hubbard, an OCC spokesman, declined to comment. Wells Fargo spokesman Alan Elias said in an emailed statement that the bank can’t comment on regulatory matters, but that it takes ā€œswift action to correctā€ any behavior that violates the firm’s values.

ā€œThis matter involves documents used for internal purposes,ā€ Elias said. ā€œNo customers were negatively impacted, no data left the company, and no products or services were sold as a result.ā€

The bank’s shares dropped 1.6 percent at 2:40 p.m. in New York trading, the biggest decline in the 24-company KBW Bank Index.

The explanations of securitization contained on the websites of the government Sponsored Entities (GSE’s) clearly demonstrate what I have been writing for 11 years and reveal a pattern of illusion and deception.

The most important thing about a financial transaction is the money. In every document filed in support of the illusion of securitization, it steadfastly holds firm to discussion of paper instruments and not a word about the actual location of the money or the actual identity of the obligee of that money debt.

Each explanation avoids the issue of where the money goes and how it was ā€œprocessedā€ (i.e., stolen, according to me and hundreds of other scholars.)

It underscores the fact that the obligee (ā€œdebt ownerā€ or ā€œholder in due courseā€ is never present in any legal proceeding or actual transaction or transfer of of the debt. This leaves us with only one conclusion. The debt never moved, which is to say that the obligee was always the same, albeit unaware of their status.

Knowing this will help you get traction in the courtroom but alleging it creates a burden of proof for you to prove something that you know is true but can only be confirmed with access to the books, records an accounts of the parties claiming such transactions ands transfers occurred.

Just last year Goldman Sachs entered into settlements with state and federal governments over the sale of toxic mortgage backed securities to investors while subsequently shorting the very same securities they were selling. Goldman would agree to provide $1.8 billion in debt relief to delinquent borrowers. However, since Goldman (and likely no other identifiable party) doesn’t owns the debt, Goldman cuts its losses by repackaging the toxic debt, assigning it an AAA rating and selling it to unsuspecting investors and pension funds for a fee, thus off-loading any liability. Goldman knows the feds won’t do anything to stop its crimes spree- so why not sell mortgage backed securities you know are toxic?
Goldman has once again successfully masterminded a new strategy to satisfy the $1.8 billion settlement without having to fund a dollar of that outstanding obligation, and while also profiting on this RICO scheme.
Goldman’s plan includes buying up billions of dollars of non-performing and defective loans at massive discounts. Goldman just announced they were purchasing 4.5 billion dollars in non-performing loans from Fannie Mae. It would be interesting to research if Fannie Mae discloses that these loans have material defects that cannot be remedied.
Goldman then contacts the homeowners and negotiates loan modifications by incentivizing the homeowner to participate by reducing their principle balance. Most desperate and unsuspecting homeowners have no idea that Goldman is acting as a debt collector and there is no underlying party that owns the debt or has a right to modify the mortgage contract in the first place. Once the modification is signed, in theory, a ā€œnewā€ loan is issued that rectifies all past endorsement, assignment and trust issues, while whitewashing all prior fraud.
The homeowner is now making payments on a new loan that is less than Goldman’s initial discount on the original purchase. Goldman than credits the principle forgiveness against its $1.8 billion dollar mortgage relief obligation while making money! Goldman is able to skirt the punishment and the fine costs them nothing because the debt was acquired at an even larger discount.
Finally, the true ingenuity of this plan emerges. Once the loan is modified and performing, the loans can be repackaged and resold as Triple-A paper once again to unsuspecting buyers.
The Wall Street Journal reports that the debt scavengers at Goldman Sachs are the largest buyer of Fannie Mae’s non-performing loans, having purchased $5.7 billion worth of unpaid loans over the past several months. Goldman Sachs should have been barred from ever participating in mortgage backed securities transactions after its last criminal enterprise.
Over the past year-and-a-half, Goldman Sachs has become the largest buyer of severely delinquent home loans from Fannie Mae. In fact, Goldman has acquired nearly two-thirds of $9.6 billion in loans the agency has auctioned off, representing unpaid loan balances in excess of $5.7 billion, according to the Wall Street Journal’s review of government records.
In all, Goldman has spent roughly $4.5 billion on some 26,000 Fannie-owned loans, according to government records. It has also been buying mortgages, from private sellers and Freddie Mac. Apparently while everyone is unloading zombie mortgage loans, Goldman Sachs is buying as much toxic sludge that is available.
According to the government-sponsored enterprise, the portfolio was split into four pools of loans and auctioned off.
The winning bidder of the smallest of the four pools is Igloo Series II Trust (Balbec Capital). That pool contained 1,465 loans that carry an aggregate unpaid principal balance of $246,748,844.
The pool has an average loan size of $168,429; a weighted average note rate of 4.51%; a weighted average delinquency of 29 months; and a weighted average broker’s price opinion loan-to-value ratio of 78.75%.
The remaining $1.43 billion in unpaid principal balance went to MTGLQ Investors, a ā€œsignificant subsidiaryā€ of Goldman Sachs.
MTGLQ Investors is now a fixture among the NPL sales from both Fannie Mae and Freddie Mac.
Last year, MTGLQ Investors bought billion-dollar pools of NPLs from Fannie and Freddie in several different sales.
In this latest sale, MTGLQ Investors bought the remaining three pools of NPLs.
The first pool contained 3,062 loans that carry an aggregate unpaid principal balance of $496,205,215.
Goldman has an excellent business plan. By renegotiating and repackaging worthless mortgage loans it can polish high-risk loans into grade-A paper. The pension funds take on all of the risk if the homeowners default, and Goldman will have kicked the can down the road to the newest suckers in the scheme.
On Tuesday Goldman won the majority of defective loans at Fannie Mae’s latest auction, its largest to date. The bank bought about 8,000 loans with unpaid balances of $1.4 billion.
Goldman has paid between 50 and 90 cents on the dollar for the loans, according to Fannie Mae, however, some (if not all) of these loans are likely not worth a dime until fraudulently modified.
Meanwhile, because Goldman is getting credit toward fulfilling the terms of its settlement, it can afford to pay more for the delinquent loans than other competing bidders, which essentially means they’ve not only created but they have cornered an entire market.

Yes, Electors can be bought off to vote for anyone they want… democracy be damned!

There is no Constitutional provision or Federal law that requires Electors to vote according to the results of the popular vote in their states. Some states, however, require Electors to cast their votes according to the popular vote.

The U.S. Supreme Court has held that the Constitution does not require that Electors be completely free to act as they choose and therefore, political parties may extract pledges from electors to vote for the parties’ nominees… The Supreme Court has not specifically ruled on the question of whether pledges and penalties for failure to vote as pledged may be enforced under the Constitution. No Elector has ever been prosecuted for failing to vote as pledged.

The bribery of Electors is, of course, the nullification of democracy in America, since it means wealthy globalists can simply buy off the electoral votes and put anyone they want into the White House… the voters be damned.

When the American people realize their votes have just been nullified through massive bribery and corruption, they are going to revolt like we’ve never seen before. They will take to the streets in protest, and the greater the margin of victory in the popular vote by Donald Trump, the more angry the voters are going to be.

We have quite simply reached the point in American history where the people will no longer tolerate the theft of power and massive election fraud that’s now routinely pursued by democrats (and especially Clinton operatives). Now what would have happened if this molten material had escaped from the containment?… A radius of 250 kilometers — which includes the city of Tokyo — anyone living in this area, if you count them up it comes to 50 million or 40% of the Japanese population, and they would all have had to be evacuated. As we know from Chernobyl, not just a couple of weeks, but 30 years or 40 years — it would have virtually meant the end of Japan. [Note: Many nuclear experts believe the molten fuel did in fact escape from the containment] Half the population was subject to radiation [Japan Population: 127 million]. That’s something that could just be imagined, for instance the event of losing a major war.

Times, Feb 25, 2016 (emphasis added): Fewer sea lions have been stranded this year, but that’s a bad sign, scientists say… it’s a sign that the sea lion population is dwindling rather than recovering. An ongoing fish famine is preventing mothers from producing enough milk, resulting in smaller and less hardy pups. As of Monday, there had been 375 sea lion strandings so far in 2016… about 160 sea lions are found stranded during the first two months of a typical year… [L]ess available prey are hurting newly born sea lions the most, potentially slowing down the species’ population growth, scientists say. ā€œIt’s going to decline,ā€ said Sharon Melin, wildlife biologist at the NOAA Alaska Fisheries Science Center… During NOAA’s survey of the sea lion breeding grounds, Melin said, researchers saw more dead pups than usual. The increased mortality could cause fewer pups to become stranded because they’re dying before they can leave the islands, she said. It is being referred to as Cthulhu-geddon.
Squid have washed up on Santa Maria Island off Chile this week in what some have described as biblical proportions. Thousands of dead and dying squid are piled up on the shore. While some squid normally do wash up this time of year, it’s never been in this large of a quantity.

Exact reason for this die-off is unknown, but some experts claim it might be a sudden drop in oxygen content in the water or an increase in water temperatures. They just really don’t know.

Of course, just like all the other mass die-offs up and down the Pacific coast in recent years, no one in any official capacity is pointing to the Fukushima disaster, still dumping tons of radioactive water into the sea as it has been for the last half a decade now just across the globe from Chile.

In the aftermath of Japan’s Fukushima nuclear power meltdown following the tsunami of March 11, 2011, the international community has totally failed in keeping the public properly informed and protected from the fallout.

Scientists and environmental officials continue to express concern, even now, at the unusual events and wonder about the causes. At the same time, the media present the facts, but fail to make any connection whatsoever to the ongoing state of affairs stemming from the tragic 2011 events at Fukushima.

Here are a few recent examples:

Seabird die-off reported around Kodiak, Alaska: A September 2015 audio report from Robin Corcoran, biologist from the Kodiak Wildlife National Refuge, confirms local reports that ā€œemaciatedā€ bird carcasses are washing up on Kodiak Island shores. Corcoran states that the birds were ā€œshowing up in places where people don’t normally see them . . . foraging, trying to find forage fish.ā€

The KMXT narrator quoted Corcoran as saying it was unclear what caused the deaths but ā€œcould be related to the birds’ inability to catch forage fish,ā€ while it was evident ā€œthe birds have no fat on their bodies and they don’t have any food in their digestive systems which indicates that they starved.ā€

Corcoran confirms that the last major bird die-off experienced in the region was January through March of 2012. The program concluded by stating that multiple species of birds have declined in number in other Alaska regions, according to surveys taken by the Wildlife Refuge. The next day, KTOO reported that Corcoran speculated on several causes for the die-off: ā€œflight feather molt,ā€ā€œwhale die-offs,ā€ or ā€œharmful algal blooms . . . related to warm ocean temperatures.ā€

A few days before the Kodiak reports, The Daily Astorian headlined: ā€œScientists Searching for Answers in Bird Die-Off.ā€ Julia Parish, speaking on behalf of the University of Washington’s Coastal Observation and Seabird Survey Team, states that the spikes in deaths are two to three times higher than normal. Josh Saranpaa of the Wildlife Center of the North Coast was quoted as saying, ā€œEvery bird we’re seeing is starving to death. It’s pretty bad.ā€ Saranpaa added, ā€œWhen you see so many starving, something is not quite right out there.ā€

The warming ocean and the toxic algae bloom are offered as possible explanations for the die-offs. Warming oceans, it is explained, cause the fish to swim deeper than the birds can dive while the toxic algae bloom runs from California straight up to Alasak. Parish concludes that it has been a really ā€œoddā€ year with multiple regional scale events. She says that there is not much that researchers can do except wait and watch.

Julia Reis of the Half Moon Bay Review writes with understatement, ā€œThere have been noticeable changes in the Pacific Ocean that have caused difficulties for marine life of late.ā€

Gerry McChesney of the Farallon National Wildlife Refuge says that the die-off has him all the more ā€œbaffledā€ because of the strip of cold water in his area full of food for these birds. In my mind’s eye, I can see McChesney scratching his head as I read that he considers poisoning, starvation, and El Nino as possible causes for the die-off. The article ends with the following comment by McChesney, ā€œWe might have to see some other problem in the ocean before we understand what’s causing the die-off.ā€

ENENews.com points to the problem of the massive die-off happening from San Diego to Alaska—all along the West Coast of the U.S. It highlights in various reports words like ā€œstrange,ā€ ā€œunprecedented,ā€ ā€œcrazy,ā€ ā€œworst,ā€ with this iconic quote from The Sacramento Bee: ā€œOur gut tells us there is something going on in the marine environment.ā€

Behrens [1] published an open access 2012 model simulation of cesium 137 (137Cs) released into the Pacific Ocean as a result of the Fukushima incident and found that after the first two to three years, tracer elements descended to depths of more than 400 meters, reached the Hawaiian Islands after about two years, and North American territorial waters after about five to six years.

Although in decreased rates of concentration from the initial injection, the entire northern Pacific basin becomes saturated with tracer fluids in this simulation. This study finds that the radioactivity remains at about twice pre-Fukushima levels until about Year Nine when radioactivity tapers to pre-Fukushima levels. This research specifically does not investigate the biological effects of increased radioactivity in the Pacific Ocean.

In 2011, Lozano [2] investigated reports of man-made cesium atmospheric detection as far away as the Iberian Peninsula. Mangano and Sherman [3] take their 2015 investigation of Fukushima radiation exactly into a potentially politically uncomfortable, but essential space: biological effects. They look at ā€œcongenital anomaliesā€ that occurred in the U.S. western states after the arrival of radioactive Fukushima Fallout. And they found that while in the rest of the U.S., birth defects decreased by almost four percentage points, on the U.S. West Coast, defects increased by thirteen percent.

Even U.S. soldiers are now experiencing Fukushima Fallout with exposure hitting home in health effects and birth defects. The Woods Hole Oceanographic Institution explains how Fukushima radioactivity reaches ocean life from both air and sea discharges. These air, ground, or sea discharges, by the way, continue twenty-four hours a day, seven days a week. Arne Gundersen of Fairewinds.org estimates that by 2015 at least 23,000 tanker truckloads of radioactive water have been released into the Pacific Ocean ā€œwith no end in sight.ā€

Please tell me whatever happened to the Precautionary Principle in public policy? [4] Is profit more important than prudence? Finally, a 2015 study by Synolakis and Kanoglu [5] finds that the Fukushima tragedy was preventable. They conclude that due to design flaws, regulatory failures, and ā€œarrogance and ignorance,ā€ and concludes that Fukushima Daiichi was ā€œa sitting duck waiting to be flooded.ā€

With all of this as background, the media provide coverage of marine anomalies mentioning global warming, even El Nino and toxic algae, while the elephant in the room is Fukushima radiation. It is this silence that is deafening! It makes me wonder who are the beneficiaries of the nuclear power business? Why is the nuclear power lobby so strong when the dangers are clearly so evident? Instead, we are told: ā€œIt is fossil fuels that are destroying the planet. Nuclear power is clean and safe.ā€ I’m also told that nuclear power is a sign of modernity; it is the future. But solar, geothermal, and wind are rarely given a mention by these same individuals. I’m also told that by posing these questions, I’m fearmongering.

I do want to know why in the face of what appear to be Pacific Ocean die-offs, El Nino is mentioned and not the Fukushima-related elevated levels of radiation. As long as there is a palpable lack of transparency in the mainstream media’s ordinary coverage of extraordinary environmental events, that includes what one senses as a reticence to discuss the obvious, I predict that there will be a proliferation of citizen journalists and citizen scientists seizing upon each piece of new data trying to make sense out of a government-approved narrative that just doesn’t make sense—again.
US President Obama stated, ā€œWe do not expect harmful levels of radiation to reach the West Coast, Hawaii, Alaska, or U.S. territories in the Pacific.ā€

We should not rely on government officials to tell us the truth about the full extent of Fukushima’s fallout: Incredibly, Obama advised the people of the U.S. not to take precautionary measures beyond ā€œstaying informed.ā€ Canada immediately suspended measurements of radiation around Vancouver. The government of Japan has not been trustworthy from the very beginning about the extent of the tragedy.

Detections at the Livermore Site and Livermore off-site locations [in California] for plutonium-239+240 are attributed to a number of factors including the following: resuspension of plutonium-contaminated soil (see Chapter 6); ambient air from historical operations; resuspended fallout from previous atmospheric testing; or fallout from the Fukushima nuclear accident.
The highest values and percentage of the DCS for the plutonium-239+240 detections were as follows: Livermore Site perimeter: 13.4 nBq/m3 (0.36 aCi/m3)… Livermore off-site locations: 10.4 nBq/m3 (0.28 aCi/m3).

Fukushima has been pouring 400 tons of radioactive waste cocktail into the Pacific every day since 03/2011. Almost five (5) years now. But it remains unclear whether the mutations in plants and animals are definitively connected to the disaster at the Fukushima No. 1 nuclear power plant. All that scientists in Japan are prepared to say is they are trying to figure out the effects of radioactive cesium caused by the release of huge amounts of radioactive materials from the triple meltdown at the Fukushima plant… Scientists are seeking… signs of mutation in plants and animals in areas close to the stricken nuclear plant… Scientists have reported on mutations and abnormalities among species varying from fir trees and plant lice to Japanese monkeys, carp and frogs. The National Institute of Radiological Sciences (NIRS), a government-affiliated entity, said in late August that the trunks of fir trees are not growing vertically. Fir trees are among the 44 species that the Environment Ministry asked the NIRS and other research organizations to study in trying to determine the effects of radiation on living creatures. The NIRS reported that the frequency of these mutations corresponds to a rise in natural background radiation. More than 90 percent of fir trees in the town of Okuma, just 3.5 kilometers from the crippled plant, showed signs of abnormal growth… Among other changes reported: the legs of plant lice collected in Kawamata, a town more than 30 km from the plant, were found to be missing or crooked and the white blood cell count of Japanese monkeys was lower in Fukushima, the prefectural capital, which is about 60 km from the plant… There is also a possibility that some animals, even if they exhibited signs of radiation’s effect, may no longer be alive for analysis.

Federal Judgeships and Caseloads

Did the Georgia secretary of state release the Social Security numbers, driver’s license numbers, and dates of birth of every registered Georgia voter? Those are the allegations first made by putative class representatives Elise Piper and Yvette Sanders in a recently filed Fulton County Superior Court lawsuit and confirmed by recent statements by the secretary of state.

The office of Secretary of State Brian Kemp attributes the data leak to a “clerical error,” which it alleges involved the dissemination of CD-ROMs containing extraneous data to only 12 recipients and that the disks are in the process of being recovered.

Piper and Sanders also allege that, despite being on notice of the leak, the state failed to notify the affected voters, or credit reporting agencies, in violation of the Georgia Personal Identity Protection Act of 2007 (GPIPA).

As troubling as the release of this information may be to voters—who may be dubious that the leak has been contained and are concerned about the risk of identity theft or fraud—it is unclear what, if any, legal remedy is available to plaintiffs.

The Data Leak
Per the complaint, the Social Security and driver’s license numbers were collected as part of the voter registration process. However, the suit alleges that although the voter registration process only required the last four digits of each voter’s Social Security number, the Secretary of State’s Office nonetheless maintained “each voter’s complete Social Security and driver’s license number.”

Some voter identification information, such as names and addresses—but not Social Security and driver’s license numbers—is regularly maintained in a “voter file” which is routinely provided on CD-ROM to media members and political parties free of charge. The voter file is also available to the general public for a $500 fee. However, plaintiffs allege, when the October 2015 voter file was distributed, it not only contained standard voter identification information but also the Social Security number, driver’s license number, and date of birth for all 6,184,281 registered Georgia voters.

The Georgia Personal Identity Protection Act
Legally, the type of data released is a distinction with a difference. GPIPA—like many similar state data breach notification statutes—defines “personal information,” in relevant part, as “an individual’s first name or first initial and last name in combination with any one or more of the following data elements,” including a Social Security number or driver’s license number. Thus, while the dissemination of the standard voter file containing voters’ names and addresses alone likely did not constitute a release of protected personal information, the alleged release of that information in conjunction with Social Security and driver’s license numbers could be deemed a breach.
Of course, even if the information was—as it appears to be—”personal information,” that is not the end of the inquiry. Other key questions include whether the Georgia Secretary of State is an “information broker or data collector” subject to the act, whether the release of the information was a “breach of the security of the system” within the meaning of the act, and whether the state failed to comply with the notice requirements of GPIPA.

Based on what we know, it would appear the answers to the first two questions are yes. GPIPA defines a data collector to include state agencies and actors as long as they are not maintaining records “primarily for traffic safety, law enforcement or licensing purposes or for purposes of providing public access to court records or to real or personal property information.” Assuming the Office of the Secretary of State cannot meet any of these exceptions—as seems likely—it is a “data collector.”

Likewise, the act defines “breach of the security of the system” to mean “unauthorized acquisition of an individual’s electronic data that compromises the security, confidentiality or integrity of personal information.” Again, based on the available information, this definition would appear to have been met by the dissemination of the personal information to media and political parties.

That said, the secretary of state may argue that the release of the information to a mere dozen people, followed by prompt efforts to recover the disks and contain the leak, did not jeopardize “the security, confidentiality, or integrity of personal information.” Of course, the fact that plaintiffs’ counsel apparently ended up with one of the disks undermines these arguments.

Turning to the next question, if GPIPA applies and the release was a breach, what was the Office of the Secretary of State required to do?
Under GPIPA, any information broker or data collector “shall give notice of any breach of the security of the system following discovery or notification of the breach” to Georgia residents whose unencrypted personal information was “acquired by an unauthorized person.”
With regard to timing, the notice shall be made “in the most expedient time possible and without unreasonable delay, consistent with the legitimate needs of law enforcement.” Law enforcement may delay notification if “a law enforcement agency determines that the notification will compromise a criminal investigation.”

Finally, where, as here, a breach requires notification to more than 10,000 residents, the data collector must also inform “all consumer reporting agencies.” Per the complaint, the secretary of state’s office did not provide notice to affected voters or consumer reporting agencies in the approximately one-month since the release, which could constitute a lack of notice.

On the other hand, perhaps the state can argue that the length of time that has passed since the potential breach without notification was not an “unreasonable delay” in light of the facts surrounding the release.

As for the type of notice required, the act typically requires written, telephonic, or, with prior permission, electronic notice. However, where the cost of the notice, as here, would exceed $50,000 or the breach affected more than 100,000 individuals, “substitute notice” may be appropriate. This can include notice by email (when known), conspicuous notice on the entity’s website, and notification via statewide media.
Thus, in this case, the statute could likely be satisfied with a press release and conspicuous notification on the Secretary of State web page—an embarrassment, perhaps, but not a huge logistical hurdle.

Do Plaintiffs Have a Case?
Despite the possibility that the secretary of state’s office may have violated GPIPA, plaintiffs’ remedy, if any, is unclear. Notably, plaintiffs have not sued for damages—likely because GPIPA does not expressly allow damages, and, regardless, seeking damages would likely trigger a sovereign immunity fight. Rather, the suit seeks equitable relief requiring the secretary of state to comply with GPIPA’s notification requirements and “prevent future harm due to the disclosure,” and attorneys’ fees.

While it is difficult to imagine that GPIPA was enacted without any enforcement mechanism or remedy—unlike many other states’ data privacy laws—GPIPA does not expressly create an independent civil cause of action, contain any statutory remedies or provide for an award of attorneys’ fees.

Moreover, while the only two published cases that have examined the act have not foreclosed a private right of action, neither has expressly found one, either. In the first, Willingham v. Global Payments, the Northern District of Georgia held the act inapplicable because the plaintiffs in that case were not residents of Georgia.
More recently, in an opinion arising out of the In re Target data breach litigation, the court allowed plaintiffs’ GPIPA claim to survive a motion to dismiss because “Georgia’s data-breach-notice statute is silent as to enforcement” and “neither party cites any case regarding how a court should interpret silence as to enforcement under Georgia law.”

The plaintiffs’ chance of success is unclear based on the paucity of case law examining GPIPA—and the fact that no court has affirmatively found a private cause of action.

Lessons for Government and Industry
Although the merits of plaintiffs’ suit are an open question—both because the secretary of state may have a viable defense and because GPIPA may be relatively toothless—it still carries important lessons for businesses and others collecting and processing personal information.

First, the Secretary of State Office’s “clerical error” illustrates the risk of collecting more data than needed. If only the last four digits of voters’ Social Security numbers were necessary, then the retention of complete Social Security and driver’s license numbers appears to have been an unnecessary risk that, in this case, led to a substantial data leak and litigation.

Second, those collecting and processing personal information should know—and comply with—data breach notification laws. For larger companies, this likely means compliance with various states’ disclosure laws—many of which have much clearer penalties and enforcement mechanisms than GPIPA.

Finally—and perhaps most fundamentally—data collectors and custodians should have a robust information management program in place that is commensurate with the volume and sensitivity of the data at issue. Simply put, a data management system with sufficient checks and safeguards should prevent a “clerical error” from potentially putting millions at risk.

It is interesting that a cancer center is getting involved with this Hanford-area birth defect cluster, especially when that cancer center played a key role in the controversial ā€˜Hanford Thyroid Disease Study’.

According to a review of the study by the National Academy of Sciences: ā€œit appears that the Fred Hutchinson Cancer Research Center in Seattle enjoyed greater public trust than the federal agencies while carrying out the HTDS… [The study’s] public summary… was misleading…  the results of the HTDS were presented with unqualified certainty… Statements attributed to the HTDS investigators appear to have overstated the certainty of the results [such as claiming:] ā€˜These results provide rather strong evidence that exposures at these levels to 131I do not increase the risk of thyroid disease or hyperparathyroidism. These results should consequently provide a substantial degree of reassurance to the population exposed to Hanford radiation that the exposures are not likely to have affected their thyroid.ā€™ā€

NBC Right Now, Aug 1, 2014: Local Birth Defect Moms Asking Why They’re Excluded From Cluster — ā€œIt’s terrifyingā€ā€¦ said Nikki Shelton. Her son Corbin was born just months ago with Spina Bifida. She didn’t know he’d have a defect until he was born… When we asked Shelton and Alicia Jones, whose son Noah has the same defect, if they were under the assumption the Department of Health was including them under their research they both said, ā€œYesā€. ā€œTo come to find out that they’re heading onwards with anencephaly and not looking into Spina Bifida is disheartening,ā€ explained Shelton… In Spina Bifida the baby is born with part of their spinal cord sticking out.

On the ā€˜Washington Neural Tube Defects Cluster’ Facebook page, Nikki Shelton recently wrote: ā€œI wanted you all to have a few numbers to reference to see just how rapidly the Neural Tube Defects are rising in our area. The Department of Health says we are 4 times the national average but we have to be WAY higher than that!… Physicians in Washington are NOT required to report birth defects!! The hospitals also code any termination/miscarriage as a ā€œComplication of Pregnancyā€. There are many families that choose to abort once they find out their unborn child has a defect, these are NOT counted in the national average. Not to mention all the defects that are not being reported by the physicians!!!ā€

Perhaps state officials will see this report that was posted on their own website… yet no longer available: ā€œStudies by Lowell E. Sever, an epidemiologist with Battelle’s Seattle Research Center, and others reported an association between neural tube defects [anencephaly/spina bifida] and the radiation dose fathers received before their children were conceived. Thiseffect was observed in children whose parents received low doses (100 millisieverts or less) of external whole-body radiation while working at Hanford… Other research suggests there is reason to believe that radiation exposure before pregnancy can increase the frequency of birth defects… Sever and others also conducted a study of birth defects in Washington’s Benton and Franklin counties near Hanford. The researchers examined the number of cases of certain birth defects between 1968 and 1980. There were more neural tube defects than expected when the county rates were compared with rates from Washington, Oregon and Idaho… Conclusion — As with other health effects from radiation, it is assumed that any exposure to radiation carries some risk of genetic effects and birth defects.ā€

hwassermanThe catastrophe at Fukushima was not an accident. It’s unfolding again in California.

The next west coast quake could easily shake the two reactors at Diablo Canyon to rubble.

They are riddled with defects, can’t withstand potential seismic shocks from fiveĀ major nearby fault lines, violate state water quality laws and are vulnerable to tsunamis and fire.

Diablo’s owner, Pacific Gas & Electric (PG&E), is in deep legal and financial crisis.

A 42-page report from NRC inspector Dr. Michael Peck says new fault line discoveries challenge Diablo’s ā€œpresumption of nuclear safety.ā€

The California Public Utilities Commission (CPUC) has just proposed that PG&E be fined $1.4 billion for a 2010 gas explosion and fire that killed eightĀ people and obliterated a neighborhood in San Bruno. The federal government has announced 28 indictments, meaning the CPUC fine may just be the tip of a very expensive iceberg for PG&E. The San Bruno disaster was caused by pipeline defects about which PG&E had been warned for years, but failed to correct.Ā The fines cover 3,798 separate violations of laws and regulations, both state and federal. PG&E was previously fined $38 million for a 2008 pipeline explosion in Rancho Cordova.

Similar defects remain uncorrected at Diablo Canyon, whose radioactive cloud could span the continental U.S. in four days.Ā Mass citizen action recently shut two coastal reactors at San Onofre. It must do the same at Diablo before the next quake hits.

Ironically, as America’s Nuclear Regulatory Commission (NRC) allows Diablo to operate, all 54 reactors in Japan remain shut. Its Nuclear Regulatory Authority has just ordered the Tsuruga reactor to be scrapped because of its vulnerability to earthquakes.Ā Two more elderly reactors at Mihama may also be terminated before year’s end.

At Fukushima, Tokyo Electric Power now admits that far more radiation is spewing into the Pacific than previously admitted. Thethyroid cancer death rate among children in the area is 40 times normal. So is the still-rising childhood thyroid abnormality rate, a terrifying re-run of downwind Chernobyl.

Tepco has begun paying compensation to local suicide victims, including the widower of a woman who doused herself with kerosene before burning herself alive.

All of it predictable.

For decades Japanese citizens warned Tepco not to build reactors in an earthquake/tsunami zone. The company repeatedly ignored safety warnings and tolerated known defects that worsened the disaster.

Diablo Canyon’s twin reactors sit eight miles west of San Luis Obispo, between Los Angeles and San Francisco, surrounded by earthquake faults.

The Hosgri, three miles offshore, was found as the reactors were being built. Design specifications were never fully altered to account for it. Nor have they been upgraded for the newly-found Los Osos, San Luis Bay and Shoreline faults.Ā  The Shoreline lies just 650 yard from Diablo’s cores.

The massive San Andreas fault is just 45 miles away, about half as far as was the March 11, 2011, Richter-9.0 epicenter from Fukushima.

A shock that size from any of the fault lines near Diablo could reduce it to a seething pile of radioactive hell, far deadlier than Fukushima. Prevailing winds could blanket virtually all of North America with its deadly fallout.

The nuclear industry would immediately deny all health impacts. It would blame ā€œunpredictableā€ God and nature.

But a 42-page report from NRCĀ inspector Dr. Michael Peck says new fault line discoveries challenge Diablo’s ā€œpresumption of nuclear safety.ā€

Buried by the NRC for at least a year, it was released by Friends of the Earth and reported on by the Associated Press and the great enviro-journalist Karl Grossman, as well as by the Nuclear Information & Resource Service and Beyond Nuclear.

Peck has a doctorate in nuclear engineering and was Diablo’s chief on-site inspector for five years. He’s now a senior instructor at the NRC’s Technical Training Center in Tennessee. His status as a current NRC employee makes such a critical report highly unusual—and alarming.

Nuclear engineer Arnie Gundersen has warned about sea-level intake pipes like those at Diablo. When the tsunami struck Fukushima, he writes, ā€œThe cooling equipment along the shoreline was turned into a scrap yard of twisted metal.ā€

Then there is fire.

Diablo Canyon, writes David Lochbaum of the Union of Concerned Scientists, ā€œhas never, ever complied with fire safety regulations, not even for a second by mistake.ā€

ā€œThe one-two punch of earthquake/tsunami caused Fukushima,ā€ Lochbaum wrote in an email to me.

ā€œA one-two punch of earthquake/fire could cause Diablo Canyon.ā€

But, says Lochbaum, ā€œIt can’t be an accident. Not when the company and its alleged regulator both know that the plant does not met earthquake and fire safety regulations.

ā€œThat cannot cause an accident. Criminal negligence perhaps. At least malicious mayhem. But not an accident.ā€

More than 10,000 people were arrested trying to stop Diablo in the 1970s and ā€˜80s. During the delays they caused, PG&E found major errors in reading key blueprints involving some of Diablo’s most critical equipment.

Damage is still being tallied from California’s Aug. 25 Napa Valley quake. The 1994 Northridge quake killed 57 people, injured roughly 5,000. The Loma Prieta quake during the 1989 World Series killed 63 people, injured more than 3,700. The infamous 1906 San Francisco quake leveled the city and killed thousands.

New shocks at Diablo Canyon could dwarf all those numbers—and Fukushima’s.

Tens of millions of Americans would be irradiated. Ā Our continent’s eco-systems would be poisoned. Ā Our nation’s economy would be gutted.

But as at San Bruno, there would be no excuses.

TEPCO: The Console of the Fuel Handling Machine dropped during debris removal operation of Unit 3 Spent Fuel Pool, Sept 1, 2014 (emphasis added):

  • Accident situation: During debris removal operation from spent fuel pool, to rise the console of the fuel handling machine, the crane tried to grasp the console with its fork, but the console dropped around the middle of east side of the pool… It dropped between debris in the pool and curing material on the upper part of fuel rack… there were 2 fuels under dropped debris.
  • Time… 12:45p: Failed to grasp the console of fuel handling machine and dropped it; 2:37p: Resumed coolingthe spent fuel pool…
  • Confirmed situation and future schedule– After console dropped, parameters concerned were confirmed to be normal. (1) monitoring post : no significant change; (2) atmosphere dose of operation floor of reactor building: no significant change (3.2mSv/h); (3) water level of spent fuel pool : no significant change; (4) water level of skimmer surge tank : no significant change (confirmed after restart of cooling spent fuel pool); (5) dust monitor of operation floor of reactor building: below the detection limit (1.0Ɨ10-5Bq/cm3)
  • TEPCO will continue monitoring regularly ((1) to (4) above) until it is confirmed that the fuel rack etc. are not damaged.

ā€˜Warm blob’ keeps possible record sockeye run away from U.S. waters??? A Warm Blob?

I’ve definitely heard it all now. Ā A Warm Blob is responsible for the lack of Sockeye Salmon. Ā I wonder what kind of Blob is responsible for the Chinook Salmon coming in in low numbers. Ā What is wrong with these people admitting that Fukushima, and the three and a half years of continually bombarding the Pacific with amounts of radiation that nothing on earth can survive, is the cause? Vancouver Sun, Aug 19, 2014: An estimated 99 per cent of sockeye are migrating… through Johnstone Strait instead of the west coast of Vancouver Island.

Issaquah Press (Washington), Aug 5, 2014: Shallow sockeye numbers may hint at light salmon return […] Sadly, at least for sockeye salmon, the number through the fish ladder has dippedvery low. ā€œUnfortunately, we aren’t getting the number we had hoped for in this sockeye run,ā€ said Dani Kendall, program assistant to the Cedar River Salmon Journey… Department of Fish and Wildlife predicted 167,000… would make their way in from the Pacific… only 50,000 have come through… ā€œIt’s unfortunate, considering the high projection.ā€ As for why the prediction fell so short of the mark, Kendall said… ā€œI wish I had an answer, but I don’tā€ā€¦ chinook numbers are low as well… Department of Fish and Wildlife forecasted 4,703 of the species will show up… So far, that’s not the case.

The Epitomy of Stupidity – Southern Company Has Learned Nothing From Fukushima!

Cost overruns and schedule delays at proposed new reactors in GA, SC, andĀ TN

As the environmental movement warned 14 years ago, when the nuclear relapse was hatched by the Bush/Cheney administration, proposed new reactors at Vogtle 3 & 4 in Georgia, Summer 2 & 3 in South Carolina, and Watts Bar 2 in Tennessee are suffering major cost overruns and construction schedule delays.

Southern Alliance for Clean Energy (SACE) has published an update on Vogtle 3 & 4, which currently are suffering a 21-month schedule delay, and $1.4 billion cost overrun. The delays could well get worse, at a staggering cost increase of $2 million per day of delay!

Similarly, as reported by SRS Watch, delays of up to three years, and cost overruns topping $500 million, are afflicting the Summer 2 & 3 proposed new reactors in SC.

Note that those April 1st projected opening dates for the new reactors at Voglte and Summer, listed in the updates above, are no April Fool’s joke. GA and SC ratepayers are already being gouged for the new reactors’ troubled contstruction, on their electricity bills.

Vogtle 3 & 4’s financial risks also now implicate federal taxpayers, in the form of a $6.5 billion loan guarantee, likely to soon grow to an $8.3 billion loan guarantee. This is compliments of the Obama administration. So, if Vogtle 3 & 4 default on their loan repayment, federal taxpayers will be left holding the bag. This is 15 times more taxpayer money at risk than was lost in the Solyndra solar loan guarantee scandal. And that risk, of Vogtle 3 & 4 defaulting on its loan repayment, was judged, years ago, by the likes of the Congressional Budget Office and Government Accountability Office, as a much greater risk than Solyndra defaulting on its loan repayment.

Vogtle 3 & 4, as well as Summer 2 & 3, are Toshiba-Westinghouse AP-1000 reactors. They are experimental, never having been built before anywhere in the world, although AP-1000s are also under construction in China.

The proposed new reactor in Tennessee, that is also suffering cost overruns and schedule delays, is the Tennessee Valley Authority’s long-mothballed Watts Bar Unit 2.

To add to the irony, the existing reactors at Vogtle, Units 1 & 2, were the poster child for cost overruns in the last generation of reactor construction, coming in at 1,300% their originally estimated cost!

And the operational Watts Bar Unit 1 took 23 years to build, from 1973 to 1996!

Scientific Reports (Nature Publishing Group) — Emission of spherical cesium-bearing particles from an early stage of the Fukushima nuclear accident, Aug. 30, 2013: We analyzed the water solubility of Cs Particle 1 by comparing the particle’s shape before and after exposure to water. The results show that there was no change in shape, suggesting that the particle was insoluble to water at least during atmospheric transportation.
